AU Policies

Students

The student handbook governs compliance with copyright law for students.

Copy Machines – “You must observe all copyright laws when making copies of any material.” A single copy of a copyrighted work a student makes for individual use falls under the provisions of Fair Use.

Technology Abuses (p. 26) – “Examples of technology abuse include but are not limited to…violations of property rights and copyrights.” Also:

The use of any Arcadia University computer for copying licensed or copyrighted software (whether the software is owned by the University or not), copyrighted music, copyrighted video is strictly prohibited. Also prohibited is copying University-owned, licensed, or copyrighted software on any other computer.

Staff

The staff handbook does not govern compliance with copyright law.

Faculty

The faculty handbook contains numerous sections that address compliance with copyright law.

GUIDELINES FOR COPYING BOOKS & PERIODICALS (§50.17, pp. 81-2)

These guidelines are only suggestions. They are not part of the copyright code so adherence to them does not guarantee compliance with the law. This section comes verbatim from a publication of the U.S. House of Representatives, Office of the Law Revision Counsel, that is also in the annotated edition of the United States Code for copyright law.

INTELLECTUAL PROPERTY (§80.10, pp. 136-140)

According to this section, faculty members retain the copyrights for all work they produce. The exception is work produced at the expressed direction of Arcadia University, such as a report or institutional research. Under these circumstances, Arcadia University is considered to be the institutional producer and thus owns the copyright.

Faculty members own the copyrights to syllabi, course lectures, assignments, tests, etc., but grant license to the university to use them in a manner consistent with its educational mission. These are synopses of the policies. Refer to the faculty handbook contains numerous sections that address compliance with for details.

LANDMAN LIBRARY (§100.05, p. 155)

Reserve Materials: “The American Library Association (ALA) recommends that only one copy of photocopied material be placed on reserve. Faculty assumes the responsibility for interpreting and conforming to copyright guidelines.”

Interlibrary Loan: “The Copyright Act of 1976 severely restricts the amount of photocopying that may be done. Our library may borrow up to five articles from any one journal in any given year and may find it necessary to deny your requests if this number has been exceeded.”
